This playbook outlines the mandatory document delivery workflows for Buyer and Seller transactions once an offer is conditionally accepted or goes firm. It defines the specific seat responsibilities, required document checklists, and standard timelines to ensure legal compliance, complete file execution, and a seamless conveyance process across our tech stack.

Accountability and Communication Standards

Seat Accountability

  • Seller Listings: The Operations seat is fully accountable for the execution and direct electronic transmission of conveyance files to all legal parties.

  • Buyer Transactions: The Realtor seat is fully accountable for the direct compilation and electronic transmission of conveyance files to lawyers and lenders.

  • Buyer File Auditing: The Operations seat is responsible for verifying that the paperwork was sent by the Realtor at the conditional and firm stages, and must ensure total file completeness in NexOne once firm.

Email and Tracking Requirements

To maintain communication visibility and accurate timelines, any conveyance email sent by either Operations or a Realtor must adhere to the following formatting standards:

  • Mandatory CC: The client(s) and the primary Realtor (Lead Agent) must be carbon-copied on every external conveyance email (if operations is sending the email).

  • Mandatory BCC: The Realtor must bcc’ Operations when sending external conveyance emails to show them that the task was completed.

Buyer-Side Conveyance Workflows (Realtor Driven)

The Conditional Stage

When a buyer's offer is accepted conditionally, the Realtor must ensure that the contract documents are sent to the lender (and Lawyer, if applicable) immediately so that the financing (and status, if applicable) condition can be completed.

  • Timeline: Documents must be sent within 24 hours of conditional acceptance.

  • Operations Tracking Role: Operations must check FUB or interview the lead agent to verify that the documents have been provided to the lender and lawyer, if applicable. If the Realtor requests administrative help, Operations may step in to transmit files on the agent's behalf.

  • Required Checklist of documents:

    • Agreement of Purchase and Sale (APS)

    • Confirmation of Co-operation and Representation (CCR)

    • MLS Listing Page (Client version)

    • Deposit Receipt

The Firm Stage

Once the transaction goes firm, the Realtor must deliver remainings to the buyer's lawyer and lender.

  • Timeline: Sent within 24hrs upon the transaction reaching firm status.

  • Required Checklist of documents:

    • Agreement of Purchase and Sale (APS)

    • Confirmation of Co-operation and Representation (CCR)

    • Any Notice of Fulfillment (NOF), Amendments, or Waivers

    • MLS Listing Page (Client version)

  • Operations Completeness Role: Operations must confirm that the paperwork was sent by the Realtor. Operations is strictly responsible for ensuring that all lawyer information is uploaded into the deal record and that total folder file completeness is achieved in NexOne at this stage.

  • Opposing Counsel Integration: The Realtor must collect the listing side's (Seller's) lawyer information. If the agent requests help, Operations will assist. The Realtor must ensure that the other party’s lawyer information is uploaded to NexOne and passed along to the buyer's lawyer to allow the offices to coordinate adjustments.

Seller-Side Conveyance Workflows (Operations Driven)

The Conditional Listing Stage

When a team listing sells conditionally, file delivery is deferred to prevent administrative rework any potential legal fees, if a deal collapses.

  • Operations Role: Operations must contact the seller to see whether they have a Real Estate Lawyer in mind (if it was not already disclosed in their intake file or FUB file).

  • Data Standard: Note the choice of counsel immediately in NexOne and on their FUB file card once received.

  • Client Protocol: Inform the seller that the team will intentionally wait until the property reaches a firm sale before routing documents to their lawyer.

The Firm Listing Stage

Once the listing clears its conditional timeline and goes firm, Operations takes complete ownership of routing the conveyance documents.

  • Timeline: Processed within 24 hours of the sale going firm.

  • Operations Delivery Protocol: Gather the complete transactional paper trail and email it to the seller's lawyer. Ensure the lead agent and the clients are carbon-copied on the message.

  • Required Seller Lawyer Checklist:

    • Agreement of Purchase and Sale (APS)

    • Confirmation of Co-operation and Representation (CCR)

    • Any Notice of Fulfillment (NOF), Amendments, or Waivers

    • MLS Listing Page (Client version)

  • Opposing Counsel Integration: Operations must ask the Buyer’s Realtor which legal counsel their client has retained. Once received, Operations will log the information in NexOne and transmit that lawyer's name and contact data (phone and email) directly to our seller’s lawyer.
